A Comparative Study on the Basic Viewpoints of Sayyid Murtada and Sheikh Tusi: With an Emphasis on the Terminology of the Principles of Fiqh
Sayyid Murtada and Sheikh Tusi are two outstanding Shiite faqihs and religious-law experts, whose ideas and thoughts are based on the same sources, i.e. the Qur’anic verses and traditions approved by the Imamiyyah. They were contemporary and interacted with each other. Meanwhile, the researchers in this study have tried to identify the reasons of their disagreements in the following issues in the terminology of fiqh: authority of isolated tradition or usage, valid, extensive, nature of the commandment, manifestation of commandment in the necessity, haste and delay, etc. The authors of this article try to show that the major reason of the discrepancy in the views of these two Shiite scholars has been because of the difference in their scientific principles.
